These Terms of Service (“Terms”) govern your access to and use of tds.ltd (the “Site”) and any messaging services, including SMS text alerts, provided by TDS Creative Ltd (“TDS Creative,” “we,” “us,” or “our”). By using the Site or opting in to our SMS messaging program, you agree to these Terms.

1. Description of Service

TDS Creative provides internal operational notifications, including automated SMS text message alerts, to a designated group of staff and business partners. These alerts notify recipients when a new file has been uploaded to a shared Google Drive folder. This service is operational in nature and is not used for marketing or promotional messaging.

2. SMS Messaging Program Terms

Opt-In: You may join the SMS messaging program by texting the keyword DROPALERT to our designated Twilio number. By doing so, you consent to receive automated text messages related to file-drop notifications.
Message Frequency: Message frequency varies based on activity and is not sent on a fixed schedule.
Message and Data Rates: Message and data rates may apply based on your mobile carrier plan. TDS Creative is not responsible for any charges billed by your wireless carrier.
Opt-Out: You may cancel the SMS program at any time by texting STOP. After doing so, you will receive a one-time confirmation message and no further messages will be sent unless you opt in again.

Supported Carriers: Carriers are not liable for delayed or undelivered messages.

3. Eligibility

Our messaging program is intended for designated staff and business partners who have been invited to participate and who voluntarily opt in. You must be at least 18 years old and have the legal right to use the mobile number you provide.

4. Acceptable Use

You agree not to misuse the Site or messaging services, including by attempting to gain unauthorized access to our systems, interfering with normal operation of the service, or using the service for any unlawful purpose.

5. Disclaimer of Warranties

The Site and messaging services are provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that messages will be delivered promptly, or at all, as delivery depends on third-party carriers and networks outside our control.

6. Limitation of Liability

To the fullest extent permitted by law, TDS Creative Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of, or inability to use, the Site or messaging services, including delayed, undelivered, or misdirected SMS messages.

7. Changes to the Service or Terms

We may modify or discontinue the Site or messaging services at any time, and we may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use of the Site or messaging services after changes are posted constitutes acceptance of the revised Terms.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles.
